Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and FixLab Studios ("we," "our," or "us") governing your use of our website and services.

By accessing our website or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or use our services.

Services

FixLab Studios provides web design, development, and related digital services including but not limited to:

• Website design and development
• Contact form and lead capture systems
• Client portal development
• Website maintenance and updates
• Promotional content creation

The specific scope, deliverables, and timeline for each project will be agreed upon in writing before work begins.

Project Process

Inquiry and Proposal

After receiving your project inquiry, we will provide a proposal outlining scope, pricing, and estimated timeline. Projects begin only after written approval of the proposal and receipt of any required deposits.

Communication

We will communicate project updates through our client portal and/or email. Timely responses to requests for feedback, content, or approval help ensure projects stay on schedule.

Revisions

Each project includes a reasonable number of revision rounds as specified in your proposal. Additional revisions beyond the agreed scope may incur extra charges.

Delivery

Upon completion and final approval, we will deliver all agreed-upon files and assets. Delivery timelines are estimates and may vary based on project complexity and client responsiveness.

Payment Terms

• Prices are quoted in USD unless otherwise specified
• A deposit may be required before work begins (typically 50%)
• Final payment is due upon project completion and before file delivery
• We accept payment via bank transfer, credit card, or other agreed methods
• Late payments may result in project delays or service suspension

Intellectual Property

Your Content

You retain ownership of all content you provide (text, images, logos, etc.). By providing content, you grant us permission to use it for the purpose of completing your project.

Our Work

Upon full payment, you receive ownership of the custom work created specifically for your project, including:

• Custom HTML, CSS, and JavaScript code
• Custom graphics and design elements created for you
• Website files and assets

Third-Party Assets

Some projects may include third-party assets (fonts, stock images, libraries) which are subject to their own licenses. We will inform you of any licensing requirements.

Portfolio Rights

We reserve the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.

Client Portal

Access to our client portal is subject to the following:

• You are responsible for maintaining the confidentiality of your login credentials
• You must provide accurate information when creating an account
• You may not share your account with unauthorized users
• We reserve the right to suspend or terminate accounts that violate these Terms

Warranties and Disclaimers

We warrant that our services will be performed in a professional manner consistent with industry standards.

However, our services are provided "as is" without warranties of any kind regarding:

• Specific business results or outcomes
• Uninterrupted or error-free operation
• Compatibility with all systems or browsers
• Third-party service availability

Limitation of Liability

To the maximum extent permitted by law, FixLab Studios shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the total amount paid for the specific service

This limitation applies regardless of the legal theory under which liability is sought.

Indemnification

You agree to indemnify and hold harmless FixLab Studios from any claims, damages, or expenses arising from:

• Your use of our services
• Content you provide
• Your violation of these Terms
• Your violation of any third-party rights

Termination

Either party may terminate a project with written notice. In case of termination:

• You will pay for all work completed up to the termination date
• We will deliver any completed work upon receipt of payment
• Deposits may be non-refundable depending on work completed

We reserve the right to terminate services immediately if you breach these Terms.

Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes constitutes acceptance of the new Terms.

For active projects, the Terms in effect at the time of project agreement will apply unless both parties agree to updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
